AN ACT to amend article one, chapter seven of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, by
adding thereto a new section, designated section three-kk,
relating to county commissions generally; authorizing county
commissions to provide for the elimination of hazards to
public safety; and authorizing penalty.
Be it enacted by the Legislature of West Virginia:

That article one, chapter seven of the code of West Virginia,
one thousand nine hundred thirty-one, as amended, be amended by
adding thereto a new section, designated section three-kk, to read
as follows:
ARTICLE 1. COUNTY COMMISSIONS GENERALLY.
§7-1-3kk. Authority to provide for the elimination of hazards to
public health and safety; penalty.

In addition to all other powers and duties now conferred by law upon county commissions, commissions are hereby authorized to
enact ordinances, issue orders and take other appropriate and
necessary actions for the elimination of hazards to public health
and safety and to abate or cause to be abated anything which the
commission determines to be a public nuisance. The ordinances may
provide for a misdemeanor penalty for its violation. The
ordinances may further be applicable to the county in its entirety
or to any portion of the county as considered appropriate by the
county commission.
